1. Introduction

  1. MTN offers Home and Business internet solutions through its Fibre Broadband Service (“MTN Fibre”).
  2. Fibre Broadband Services are available only in selected areas with Fixed Broadband Network Coverage.
  3. Customers must verify service availability by conducting a coverage check via the MTN Coverage Map to confirm that their address falls within MTN’s Fibre Broadband Service Area.

2. Definitions

In these Terms and Conditions, the following definitions apply:

• Annual Plan means a fibre broadband subscription plan with a fixed duration of three hundred and sixty (360) days, during which the customer is entitled to access the service at the subscribed speed and within the terms of the selected plan.

• Equipment means any physical device or apparatus provided or installed by MTN for the purpose of enabling access to the fibre broadband service at the customer’s premises. This includes, but is not limited to, the optical network terminal (ONT), router, cabling, mounting hardware, and any other ancillary devices forming part of the installed service infrastructure.

• FBB means Fibre Broadband.

• Fibre Broadband Service means a high-speed internet access service delivered over a fibre-optic network infrastructure, in which data is transmitted as pulses of light through optical cables.

• Fibre Broadband Service Area means the specific locations and addresses within MTN’s fixed broadband network coverage where fibre broadband service is available for connection and active subscription.

• Fibre Number means the unique identifier assigned to a customer’s fibre broadband service connection upon activation. The Fibre Number serves as the primary reference for the customer’s account and service record and shall be used when making enquiries, logging service requests, or engaging MTN’s support channels in relation to the subscribed service.

• Fixed Broadband Network Coverage means the geographic areas in which MTN’s fixed broadband network infrastructure is deployed and capable of delivering service to customer premises.

• Flexi Plans means fibre broadband subscription plans that provide customers with a data volume allocation determined by the amount paid by the customer at the point of purchase.

• Graphic Business Subscription means a value-added service offered in partnership with Graphic Communications Ltd, providing subscribers on MTN Business Fibre plans with digital access to the Graphic Business newspaper as part of their subscription.

• Monthly Plan means a fibre broadband subscription plan with a fixed duration of thirty (30) days, during which the customer is entitled to access the service at the subscribed speed and within the terms of the selected plan.

• Postpaid Subscriber means a customer who subscribes to MTN’s fibre broadband service under a monthly billing arrangement, whereby the customer accesses the service throughout the billing period and is invoiced for applicable charges at the end of that period.

• Prepaid Subscriber means a customer who subscribes to and uses MTN’s fibre broadband service by purchasing service credit or a defined data bundle in advance of use.

• Provider means Scancom PLC (MTN).

• Quarterly Plan means a fibre broadband subscription plan with a fixed duration of ninety (90) days, during which the customer is entitled to access the service at the subscribed speed and within the terms of the selected plan.

• Security means a value-added service provided in partnership with Cloudflare, available to MTN Business Fibre customers. It protects the customer’s internet connection at the network level against selected online threats including malware, phishing, spam, and unauthorised access, without requiring any software installation on the customer’s devices.

• Semi-Annual Plan means a fibre broadband subscription plan with a fixed duration of one hundred and eighty (180) days, during which the customer is entitled to access the service at the subscribed speed and within the terms of the selected plan.

• Service means the Fibre Broadband Service which the Provider shall install to enable the Subscriber to access the internet and other online services and content.

• Service Speed means the rate at which data is transmitted to and from a customer’s premises over MTN’s fibre broadband network, measured in megabits per second (Mbps) or gigabits per second (Gbps).

• Soft Phone means a software-based telephone system enabling voice communication over the internet.

• Standard Plans means fibre broadband subscription plans under which a customer is allocated a defined data volume for consumption.

• Static IP means a dedicated internet protocol (IP) address that remains the same each time a customer connects to the internet.

• Subscriber means the legal entity or person who purchases the Service by agreeing to these Terms and Conditions. A Subscriber must be a natural person aged eighteen (18) years or older.

• Subscription Fee means the recurring charge payable by the customer for access to MTN’s fibre broadband service under a selected plan.

• Unlimited Speed Plans means fibre broadband subscription plans that provide customers with continuous internet access without a defined data cap or volume limit during the applicable subscription period.

3. Offer Eligibility

  1. This offer is available exclusively to MTN Business Prepaid and Postpaid Customers.

4. Offer Details

  1. Customers who subscribe to Monthly (30 days), Quarterly (90 days), Semi-Annual (180 days), or Annual (365 days) plans are required to make a one-time upfront payment for the selected package.
  2. All Fibre Unlimited Speed Plans are valid for the duration of the selected plan and may be renewed upon expiry.
  3. Customers may cancel their subscription at any time; however, cancellation will result in forfeiture of any remaining benefits under the active plan. Following cancellation, Customers may not re-subscribe to any Quarterly, Semi-Annual, or Annual plan for one (1) month, after which they may purchase again. This restriction does not apply to the Monthly plan.
  4. Customers can select from available plans with an Unlimited Speed Plan attached to the Fibre Number for the duration purchased.
  5. Customers who purchase an Unlimited Speed Plan can enjoy up to a 10% discount on their monthly spend, depending on the selected Plan.
  6. Customers may select a dedicated Service Speed from the options available under their subscribed plan. Only one speed option may be active on a customer’s account at any given time.
  7. Customers on a Quarterly Plan who wish to change their speed must cancel their current Plan and subscribe to a new plan after the initial 30-day period.
  8. Customers subscribed to an Unlimited plan are not eligible to subscribe to other bundle plans (including Standard or Flexi bundles). Subscription to another bundle will automatically terminate the Unlimited plan and replace it with the new Offer.
  9. . Service Speeds are subject to factors including network conditions, customer equipment, the number of simultaneous users or connected devices, and the customer’s internal wiring or Wi-Fi setup. Advertised speeds represent maximum theoretical throughputs and are not guaranteed at all times. Refunds will not be provided for speed variations where the service remains active and operational within the parameters of the Offer.
  10. Where speed-related issues are identified, MTN may troubleshoot, optimise service settings, or replace/migrate equipment where necessary.
  11. No refunds shall be provided where the Service has been used for more than seventy-two (72) hours from the date of activation or renewal, except where  MTN’s technical engineers confirm Network or service fault attributable to MTN and a  verified technical issue has been reported.
  12. Customers on Semi-Annual (6-month) and Annual (12-month) Plans may request a refund after completing a minimum of three (3) months of service usage. Such requests must be submitted with at least one (1) month’s written notice prior to termination. Any approved refund will be prorated based on the remaining unused period of the subscription, less any applicable discounts, promotional benefits, administrative charges, or fees as determined by MTN.
  13. Where a Customer reports a technical issue and such issue is validated by MTN, the affected service period may be reinstated at MTN’s discretion.
  14. Customers relocating within Fibre Broadband Service Areas must request an account freeze to preserve their Unlimited plan. The service will be reactivated once relocation is successfully completed.
  15. Customers relocating to non-Fibre Broadband Service Area with more than three (3) months remaining on their Plan may request a refund, subject to providing at least one (1) month’s prior notice. Upon submission of the request, the account will be suspended pending processing.
  16. Customers are responsible for the safekeeping of all routers and devices provided. Lost, stolen, or damaged equipment may incur replacement charges.
  17. Unlimited Speed Plans are delivered over a shared network infrastructure and are subject to Network availability. Actual speeds may vary and are not guaranteed at all times.
  18. Unlimited Speed Plans are non-transferable and may only be used by the original account holder.
  19. Customers may request an account freeze for valid reasons (including relocation) for a maximum period of one (1) month. Requests exceeding this duration may result in forfeiture of the lan.
  20. Technical support is limited to MTN-provided equipment and services. MTN shall not be liable for faults arising from customer-owned devices.
  21. MTN reserves the right to amend these Terms and Conditions at any time. Customers will be notified in advance of any material changes.

5. Confidentiality and Disclaimer

  1. The Subscriber shall be responsible for maintaining confidentiality in the use of the Service and acknowledges that the Provider does not have control and cannot monitor the Subscriber’s content and information transmitted via the internet.
  2. The Subscriber shall maintain confidentiality of passwords and other access codes to the Service.
  3. The Provider shall not be liable for the use of the Service by unauthorised persons who gained access due to leakage of passwords, nor liable for data usage by such unauthorised users.
  4. The Provider is not liable for content, material, or information that the Subscriber may find offensive or inappropriate.
  5. Internet connection over the broadband service is subject to technical feasibility.
  6. The Subscriber has a duty to securely protect the Equipment. The Provider shall not be liable for damage caused to any Equipment on the Subscriber’s premises due to power, physical, or any other type of damage.
  7. The Service may be unavailable due to operational maintenance or factors beyond the Provider’s control, including force majeure. Such interruptions will be communicated to the Subscriber.

6. Ownership and Installation of Equipment

  1. The Subscriber will be supplied with Equipment on a free-to-use basis. However, all Equipment remains the sole property of the Provider.
  2. The Subscriber must return the Equipment upon termination of the Service by any means.
  3. The Provider reserves the right to retrieve the Equipment upon termination of the Service or if the Service is dormant for twelve (12) months or more.
  4. The Subscriber is obliged to grant access to the Provider’s contractors to retrieve the Equipment.
  5. Any liability associated with the damage or theft of the Equipment shall transfer to the Subscriber once delivered to the Subscriber.
  6. Where a Subscriber loses or damages Equipment, or Equipment is stolen, the Subscriber will be liable to pay the replacement value of the Equipment at the time of loss, damage, or theft before the Provider will replace or refurbish the Equipment.
  7. Where a Subscriber requires an additional service outside the standardised Service, the Subscriber will be liable for the additional costs of installation. These costs will be specified in the quotation prior to commencement and must be settled prior to activation.
  8. The Subscriber will be required to grant the Provider’s field service agents and their representatives access to work, internally and externally, at the Subscriber’s premises for installations and maintenance. The Subscriber must ensure all necessary consents and authorisations, including planning permission where required, have been obtained from landlords, tenants and other occupants.
  9. The Subscriber accepts that cabling, mounts, poles, conduits and fixings will be used to complete the installation, and that these become the property and responsibility of the Subscriber once installation is signed off. This excludes network equipment such as infrastructure provider-installed Optical Network Terminals (“ONT”). The Subscriber is responsible for ensuring these are maintained in operational condition.

7. Charges and Payments

  1. Subscribers signing on to the Service for the first time shall pay a one-time installation fee in addition to a one (1) month Subscription Fee.
  2. The Subscriber shall make payment by MTN MobileMoney, bank transfer, Visa enablement, or other network payments (AirtelTigo and Vodafone Cash).
  3. The Provider reserves the right to review its tariffs during the subsistence of this Agreement. Updated tariffs will be published on the MTN website.

8. Relocation

  1. Subscribers are required to notify the Provider of any relocation. Upon such notification, the Provider is obligated to transfer the remaining data to the Subscriber.
  2. If the Subscriber relocates to a fibre-connected location, the remaining balance will be seamlessly transferred to their new account. In the case of relocation to a non-fibre location, the balance data will be transferred to their mobile number using the fibre-to-mobile conversion rate.

9. Termination

  1. The Subscriber reserves the right to request termination of the Service by notifying the Provider. Termination shall take effect immediately once the recharge bundle is exhausted.
  2. The Provider may terminate the Service if:
  3. The Subscriber breaches any provision of these Terms and Conditions, any applicable policy of the Provider, or applicable telecommunications or cyber security laws of Ghana;
  4. Legal or regulatory requirements require the Provider to suspend or terminate the Service; or
  5. The Provider provides 14 days’ notice to terminate the Service without reason.
  1. Upon termination of the Service, the Provider reserves the right to retrieve the Equipment.
  2. A Subscriber seeking reconnection after service termination must undergo the onboarding process applicable to a new subscriber.

10. Governing Law, Dispute Resolution, and Force Majeure

  1. The provision of the Service shall be subject to the laws of the Republic of Ghana.
  2. Any dispute arising from the provision of the Service shall be settled amicably by the parties.
  3. Any waiver by any party for any breach or default by the other party shall not be considered as a waiver for any subsequent breach or default.
  4. If the Provider’s performance under these Terms and Conditions is prevented, restricted, or interfered with by causes beyond its reasonable control, including but not limited to acts of God, fire, explosion, vandalism, cable cut, storm, or other similar occurrences; any law, order, regulation, direction, action, or request of the Government of the Republic of Ghana or any of its agencies, commissions, courts, or authorities; national emergency, insurrection, riot, war, or pandemic/endemic, the Provider shall be excused from such performance on a day-to-day basis to the extent of such restriction or interference. The Provider shall use reasonable efforts to avoid or remove such causes of non-performance.

11. Graphic Business Subscription — Terms

  1. One Subscription Per Bundle Purchase: Each broadband bundle purchase grants access to one Graphic Business subscription link. The link is non-transferable and valid for a single user account only.
  2. Subscription Validity Tied to Bundle Period: Access to Graphic Business is valid only for the duration of the broadband bundle purchased. Once the bundle expires, the subscription link becomes inactive until a new bundle is purchased.
  3. Non-Refundable and Non-Exchangeable: The Graphic Business subscription link included with a bundle cannot be exchanged for cash, data, or any other value. It is a value-add and not a standalone purchase.
  4. Single-Use Link: Each subscription link can only be activated once. Users must not share their link with others, as it will be rendered invalid once redeemed by the first user.
  5. Content Access Subject to Graphic Communications’ Platform: Graphic Business content is delivered via the Graphic News Plus Platform. Any downtime, content changes, or access issues arising from Graphic Communications Group’s systems are outside MTN’s control. Users should contact Graphic News Plus support directly for content-related issues.

12. Static IP and Embedded Security Terms

  1. Each MTN Fibre for Business account is eligible for one (1) dedicated static IP address and embedded security service, assigned to the registered account holder. The static IP and security features are non-transferable and may only be reassigned upon formal approval by MTN.
  2. Static IP assignment and activation of embedded security services require the customer’s router to be online and connected to the Network. Customers are responsible for ensuring their equipment remains operational to facilitate service provisioning.
  3. The static IP address and embedded security service remain active only while the Customer’s broadband subscription is active. If the Service is terminated, expires, or remains inactive for an extended period, MTN reserves the right to withdraw, reassign, or modify the static IP address and associated security configurations.
  4. While MTN will make reasonable efforts to retain an assigned static IP upon subscription renewal, continuity of the same IP address is not guaranteed where there is a lapse in service or for operational, technical, regulatory or network management reasons.
  5. The static IP address may only be used on the designated MTN-approved router and must not be shared across multiple devices or connections simultaneously.
  6. Customers shall not use the static IP address or broadband service for any unlawful, abusive, fraudulent, or malicious activities, including but not limited to hosting illegal content, cyberattacks, spam distribution, unauthorized servers, or activities that violate applicable laws or MTN’s Acceptable Use Policy. MTN reserves the right to suspend or terminate the service immediately in the event of such violations.
  7. MTN’s embedded security service provides network-level protection against selected cyber threats; however, it does not guarantee complete protection from all security risks. Customers remain responsible for securing their networks, devices, applications, credentials, and data. MTN shall not be liable for any losses, breaches, unauthorized access, malware infections, or security incidents arising from customer actions, configurations, or circumstances beyond MTN’s reasonable control.
  8. The static IP address and embedded security service are value-added features included with the broadband subscription and carry no separate monetary value. They are non-refundable, non-exchangeable, and cannot be converted into cash, airtime, data, or any other service benefit.
  9. If the assigned static IP address becomes blacklisted by third-party platforms or services as a result of the customer’s activities, the customer shall be solely responsible for resolving such blacklisting. MTN is under no obligation to secure the removal of any such restrictions.
  10. Customers experiencing issues relating to their static IP address or embedded security service should contact MTN Business Support. MTN will use reasonable efforts to resolve faults within applicable service levels but does not guarantee uninterrupted service where disruptions arise from third-party networks, force majeure events, or factors beyond its reasonable control.

By subscribing to any MTN Business Fibre Broadband Service, the Subscriber agrees to be bound by these Terms and Conditions.
